Website Maintenance, Hosting & Domain Services

These Terms & Conditions govern the provision of website maintenance, hosting, and domain management services by Molaray (“Service Provider”) to its clients (“Client”).

1. Website Build Services

1.1 What a Website Build Includes

Unless otherwise agreed in writing, a website build includes:

  • Design and development of a website based on agreed structure, pages, and scope
  • Implementation of a CMS (e.g. WordPress or equivalent)
  • Installation and configuration of themes and plugins required for agreed functionality
  • Basic performance and security configuration
  • Integration of third-party tools or systems as provided, without custom development
  • Delivery of a functional website ready to go live

The website is considered delivered and accepted once it is made live or formally approved by the Client.

1.2 What a Website Build Does NOT Include

A website build does not include unless explicitly agreed in writing:

  • Custom software or plugin development
  • Modification of third-party booking, payment, or external systems beyond their standard capabilities
  • Ongoing content creation, copywriting, or imagery
  • SEO strategy, ranking guarantees, or advertising performance
  • Legal compliance (GDPR, cookie consent, accessibility laws, industry-specific regulations)
  • Data migration unless explicitly agreed
  • Training beyond basic handover explanations
  • Ongoing support, hosting, or maintenance (unless covered by a separate plan)

Once delivered, any changes, fixes, or additions are out of scope unless agreed separately.

2. Maintenance Services (If Applicable)

Maintenance applies only to the website as delivered or last approved and includes:

  • CMS core updates
  • Theme and plugin updates
  • Basic security and uptime monitoring
  • Monthly off-site backups
  • Performance and stability checks
  • Minor bug fixes related to existing functionality

Maintenance does not cover new features, redesigns, or issues caused by unauthorised changes.

3. Hosting Services (If Applicable)

Hosting services include:

  • Managed server hosting
  • SSL certificate (where supported)
  • Server-level security configuration
  • Basic caching and performance optimisation
  • Server monitoring

Hosting resources are intended for normal usage. Excessive traffic, storage, or misuse may require an upgrade or result in suspension.

4. Domain Holding & Management (If Applicable)

Where included:

  • Domains may be registered and/or held on behalf of the Client
  • Renewals are managed during the active service period
  • Required DNS settings are maintained

The domain remains the property of the Client. Upon termination and full payment, the domain will be transferred to the Client or their nominated provider.

5. Exclusions (Always Excluded)

The following are explicitly excluded unless agreed in writing:

  • Custom development of third-party software or plugins
  • Emergency fixes caused by:
  • Weak, shared, or compromised credentials
  • Client or third-party modifications
  • Unpaid external services
  • Malware or hacking not caused by Service Provider negligence
  • Data loss caused by third-party services
  • Business interruption, missed revenue, or reputational damage


6. Client Responsibilities

The Client agrees to:

  • Provide accurate and timely access credentials
  • Not install plugins, themes, scripts, or custom code without approval
  • Keep billing and contact details up to date
  • Ensure all content provided is owned or licensed by the Client

The Service Provider is not responsible for issues caused by Client actions or third parties.

7. Support & Availability

  • Support is provided during normal business hours
  • Critical availability issues are addressed within two (2) working days
  • Response times are best-effort and do not constitute a guaranteed SLA


8. Fees, Payment & Suspension

If payment remains outstanding for 30 days, the Service Provider may suspend services and take the website offline until payment is received.

No liability is accepted for losses resulting from suspension due to non-payment.

9. Term & Termination

Services run on a rolling basis according to the selected billing cycle.

Either party may terminate with 30 days’ written notice.

Immediate termination may occur in cases of:

  • Non-payment
  • Misuse of services
  • Harmful or unauthorised activity affecting system security or stability



Upon Termination

After full settlement, the Client will receive:

  • Website files as-is
  • Database export (if applicable)
  • Domain transfer (if held by the Service Provider)



Not included:

  • Ongoing hosting or maintenance
  • Continued backups
  • Support or redeployment assistance
  • Third-party licences owned by the Service Provider

No refunds are issued for partially used periods.


10. Liability – What Molaray Is NOT Liable For

Molaray is not liable for:

  • Loss of revenue, profit, bookings, or business
  • SEO rankings, traffic, or marketing performance
  • Downtime caused by hosting providers, APIs, or third-party systems
  • Security breaches caused by compromised credentials
  • Legal or regulatory compliance failures
  • Data loss outside direct Service Provider control
  • Any indirect or consequential damages

11. Ownership

  • The Client owns all website content and the domain
  • Molaray retains ownership of internal systems, workflows, tooling, and methodologies


12. Governing Relationship

These Terms & Conditions apply to all services unless replaced by a signed agreement.


In case of conflict, the signed agreement prevails.
